Barack Obama votes against freedom

Barack Obama voted against individual liberty protections today when he raised his hand in favor of H.R. 6304 which amends F.I.S.A., the Foreign Intelligence Surveillance Act. Defeat of this amendment would have taken away the immunity from civil damages and stiff penalties which telecom companies now enjoy when they enable and aid the U.S. government’s engagement in wiretaps and other forms of electronic surveillance. This loss of immunity would have essentially made it much more risky and much less likely for telecom companies to cooperate with the government in its “loosely” legal post 9/11 surveillance tactics, which ignore the need to get a court order.

This ad hoc surveillance is justified by the Bush Administration’s version of the war on terror, and for many Americans who regard the war on terror from the “fear” viewpoint, they would surely agree. September 11th did change the rules, but not enough to abandon the Constitution at the whim of a few men in power. Doing so only makes the terrorists the winner. The writers of the Constitution required an order by the Judiciary branch. This court order was handed down after reviewing the evidence and determining just cause to initiate the surveillance. This review by the Judiciary was entered into the Constitution as one of the many checks and balances against the abuse of power.

Barack Obama has been a firm opponent of this bill, and his change of position which was not taken from a sound-bite, but was recorded in the records of a vote in the U.S. Senate, will make many of his almost entranced supporters wake from their idealistic dream. It’s difficult to understand how party politics can have deteriorated to the point where a major political party is seemingly willing to forgo the strength of the U.S. Constitution in order to solidify their power base by chipping away at the people’s freedom. But over the last four decades, that seems to be the case with the Far, Religious, and Conservative Right. Naturally, free-thinking individuals have flocked to the Democratic Party as the party that keeps up the fight for freedom of expression, freedom of religion, and the freedom to not fit into the Republican mold. Many of them will feel abandoned today by the one man they saw as an emerging leader in the fight.

If Barack Obama had voted against H.R. 6304, it wouldn’t have changed the outcome. The bill would have still passed by a wide margin, but those people who are concerned about the government’s reckless regard for an individual’s civil liberties, would have felt reassured. I admit I’m disappointed, but understand the difficult position he is in. He will be picked apart by the media and the opposing party, and will find himself in many no-win situations such as today. And even when there is a lull in the newswire, the 24-hour NewsBots will poke and prod, and dig and dish until they create a story. I don’t agree with a lot of the media hype, and don’t believe Barack Obama has been negatively affected by a lot of the “Breaking News” the NewsBots have come up with.

Today’s vote did affect me though. Today’s vote affected me a great deal in my view of Barack Obama, because in my opinion, for the first time since he rocketed into the political spotlight, I saw weakness. For the first time on a major issue that affects our freedom directly, he caved into political expedience. I’m sure it was a difficult decision for him to make, and I’m sure it won’t turn away many of the people to whom this was an important issue. But if Barack Obama is elected President of the United States, thousands of people who are for freedom and peace will view the coming term with a slight after-taste of trepidation. And in the back of many people’s minds, they will wonder whether his will truly be a term of change or not. But I also think he could still prove us all wrong.
